Thai white fragrant rice of 「golden lion globe」 brand, purity of fragrant rice: 80% min, 1997/1998 new crop.

Quality
a）specifications for Thai white fragrant rice of（「golden lion globe」 brand/Hong Kong standard）are the same as Thai white rice 100% class B.
b）the rice supplied by the sellers shall be composed of pure Thai fragrant rice not less than 80 percent.
c）the rice supplied by the sellers shall be in good condition, fit for human consumption, without any unpleasant ODOUR, free from any signs of mould fermentation or deterioration as well as free from live insect pests.
d）the quality of the rice shall not be inferior in grain, color ANDMILLING to the latest export standard established by the ministry of commerce of the government of Thailand rice which does not conform with the latest standard of the government of Thailand shall be rejected or replaced.
e）the rice supplied by the sellers shall be free from the following diseases, pests and weeds dangerous to plants in accordance with the regulations of the ministry of agriculture of the people』s republic of china:
1) PROST PHANUS TRUNCATUS (HORN);

表示商品品質的方法
1．以實物表示商品的品質
以作為交易對象的商品的實際品質或以代表商品品質的樣品來表示商品的品質，包括：
（1）看貨成交
又稱憑現貨買賣，即根據現有商品的實際品質買賣。具體做法：在貨物存放地賣方向買方展示貨物，買方或其代理人逐一檢視，對滿意的貨物即與賣方達成交易。這種做法，多見於寄售、拍賣、展賣等貿易業務中。
（2）憑樣品買賣
指交易雙方規定以樣品表示商品的品質並以之作為賣方交貨品質的依據。在國際貿易實務中，有些商品難以用文字來說明其品質，代之以實物樣品來表示。
根據樣品提供者的不同，憑樣品買賣可分為：
①憑賣方樣品買賣
②憑買方樣品買賣
③憑對等樣品買賣

2．用文字說明表示商品的品質
即以文字、圖表、相片等方式來說明商品的品質，包括：
（1）憑規格買賣。
指用反映商品品質的指標，如成分、含量、性能等來確定商品品質的交易。如：「統一」鮮橙多鮮橙汁飲料，鮮橙原汁含量10%。
（2）憑等級買賣。
指同類商品因規格不同，而用文字、數碼或符號進行分類，以此來確定商品品質的交易。如2002中國綠茶，特珍一級。
（3）憑標准買賣。
指以政府機關或工商團體統一制定的標准來確定商品品質的交易。如美國的UL 是其電器電子產品的國家檢驗標准。
在買賣農副產品時，還有兩種常見的標准：FAQ「良好平均品質」（Fair average quality）和GMQ「良好可銷品質」（Good merchantable quality）。
（4）憑說明書和圖樣買賣。
對於某些工業製成品，如電器、儀表等，很難用幾個簡單的指標來反映其品質，而需要憑說明書、照片或圖樣來具體地描述其內部構造及性能，按此方式交易，稱為憑說明書和圖樣買賣。
（5）憑商標或牌號買賣。
指對某些質量穩定且在市場上有著良好聲譽的商品，買賣雙方在磋商和簽訂合同時，直接採用這些商品的商標或牌號來作為商品的品質表示，按此方式交易，稱為憑商標或牌號買賣。如「張小泉」剪刀、「海爾」家用 電器、「Software」軟體等。
（6）憑產地名稱買賣。
有些商品，尤其是農副土特產品，其品質因產地而異，交易中僅憑產地就可說明商品的品質好壞，即憑產地名稱買賣。如四川涪陵榨菜、浙江金華火腿、山東龍口粉絲等。

17 人力不可抗拒因素：
由於水災、火災、地震、乾旱、戰爭或協議一方無法預見、控制、避免和克服的其他事件導致不能或暫時不能全部或部分履行本協議，該方不負責任。但是，受不可抗力事件影響的一方須盡快將發生的事件通知另一方，並在不可抗力事件發生15天內將有關機構出具的不可抗力事件的證明寄交對方。
Force Majeure：
Either party shall not be held responsible for failure or delay to perform all or any part of this agreement e to flood, fire, earthquake, draught, war or any other events which could not be predicted, controlled, avoided or overcome by the relative party. However, the party affected by the event of Force Majeure shall inform the other party of its occurrence in writing as soon as possible and thereafter send a certificate of the event issued by the relevant authorities to the other party within 15 days after its occurrence.
18 仲裁：
在履行協議過程中，如產生爭議，雙方應友好協商解決。若通過友好協商未能達成協議，則提交中國國際貿易促進委員會對外貿易仲裁委員會，根據該會仲裁程序暫行規定進行仲裁。該委員會決定是終局的，對雙方均有約束力。仲裁費用，除另有規定外，由敗訴一方負擔。
Arbitration
All disputes arising from the execution of this agreement shall be settled through friendly consultations. In case no settlement can be reached, the case in dispute shall then be submitted to the Foreign Trad Arbitration Commission of the China Council for the Promotion of International Trade for Arbitration in accordance with its Provisional Rules of Procere. The decesion made by this commission shall be regarded as final and binding upon both parties. Arbitration fees shall be borne by the losing party, unless otherwise awarded.
