⑴ 北京發布新版租房合同示範文本：明確禁止違法群租

記者7月8日從北京市住建委獲悉，為合理引導住房租賃行為，維護租賃當事人合法權益，減少交易糾紛，降低交易成本，北京市住建委會同北京市市場監管局制定並發布《北京市住房租賃合同》《北京市房屋出租經紀服務合同》《北京市房屋承租經紀服務合同》三個合同示範文本。示範文本自發布之日起正式推行使用。

記者了解到，不同於2008年版的房屋租賃合同示範文本只是根據租賃的不同成交方式進行區分，此次發布的三個合同示範文本是分別針對住房租賃和房屋租賃經紀服務制定的，合同使用區分更加明確。

無論是通過自行成交的，或是通過經紀機構居間成交、經紀機構代理成交的，住房租賃合同均可統一使用《北京市住房租賃合同》示範文本。《北京市房屋出租經紀服務合同》《北京市房屋承租經紀服務合同》示範文本則適用於北京市依法可以出租房屋的租賃經紀服務。
此外，新版住房租賃合同增加了禁止違法群租的相關要求。《北京市住房租賃合同》《北京市房屋出租經紀服務合同》示範文本均在說明中強調，不得改變房屋內部結構分割出租、出租房屋人均居住面積不得低於5平方米、每個房間居住的人數不得超過2人等有關禁止違法群租的文件規定內容。
同時，在合同中通過設立房屋整租、分租有關事項條款，明確禁止違法群租。在《北京市住房租賃合同》示範文本中，專設有「房屋租賃形式」相關條款，約定房屋具體居住人數及分間出租時的分租房間居住面積；在《北京市房屋出租經紀服務合同》示範文本「委託出租要求」中，也明確約定了最多居住人數。

一． 租賃標的 A. TENANCY LOCATION

二． 租賃期限 B. TENANCY TERM
租期為 13個 月。自 ____年 6 月 1 日起至 _____ 年 5 月 30 日止。租賃期滿，甲方有權收回全部出租之房屋和屋內設施，乙方應如期交還。乙方如要求續租，則必須在租賃期滿前的 一 個月向甲方提出書面意向。經甲方同意後，重新簽署租賃合同。
The tenancy term shall be 13 months, which shall be from June 1st, ________ to May 30th, 2005 . At the end of the term, Party A shall have the right to take back the Premises and facilities in the Premises tenanted by Party B. Party B shall return the Premises and facilities in the Premises on time. If Party B wishes to renew this agreement, it shall notify Party A in writing no less than one month before the expiration of the term of this agreement. After the approval by Party A, both Parties shall sign a renewal agreement.

三． 租金與押金 C. RENTAL CHARGE AND DEPOSIT
該房屋和屋內設施月租金為人民幣 7037(柒仟零叄拾柒) 元整。在租賃期內全部租金分 13 次支付。簽署本合同時乙方向甲方交付人民幣 14307(壹萬肆仟叄佰零柒)元當作保證金和 1個月的租金和一個月的物業管理費，先付後住。乙方在租賃期內，7月份開始，每月租金和物業管理費須提前3天， 每月的27日向甲方交付，先付後住。人民幣 7037 元保證金作為設備、設施被破壞而發生的損失或違約責任的保證。該保證金在租約期滿結清各種費用後應予以退還（不計利息）。屆時如乙方尚有本合同第四條中所述費用的未結清部分，甲方可以從該保證金中扣除相應數額；如結清有餘，此部分餘款應歸還乙方。
The monthly rental charge of the Premises and facilities in the Premises is RMB 7037 . The rental should be paid by 13 installments within the tenancy period. Party B should pay Party A RMB 14,307 immediately after signing this agreement as the deposit and for 1 month』s rental charge and the management fee, and Party B can only access the Premises after the payments are fully made. From the second tenancy month, Party B should pay the monthly rental charge and management fee RMB7270 on the date of 27th of last tenancy month, and Party B can only access the Premises after the payment is fully made. The said deposit RMB 7037 is held against the damages of fixtures and fittings or breach of the agreement and shall be refunded (non-interest bearing) to Party B at the termination of this agreement subject to an appropriate dection in respect of the damage of fixtures and fittings or breach of the agreement. Party A has the right to dect an appropriate sum of the deposit if some payment, for other charges as described in the Article D of this agreement, are unpaid by Party B at the end of the tenancy term, then the remainders shall be refunded to Part B.

四． 費用 D. OTHER CHARGES
在租賃期內，由乙方使用的水、電、煤、有線電視、電話、(寬頻網)，物業管理費由乙方支付（也可由甲方代乙方支付，之後根據付款憑據向乙方索取）。
During the tenancy term, Party B will pay its utilities of water, electricity, gas, telephone (ADSL), premises management fee, TV fee and other expenditures (It is available that Party A pays such charges on behalf of Party B, then Party B refunds Party A for such charges upon presentation of such receipts).

五． 甲方責任 E. OBLIGATIONS OF PARTY A
1． 甲方按約定在第一次收款後應在約定日期交給乙方使用。如延誤交房日期,甲方須對乙方做出合理的補償。
Party A promises to Party B to render the Premises on the said date after receiving the said first payment. Otherwise Party A should offer reasonable compensation to Party B if Party A fails to render as promised.
2． 非乙方人為因素造成的對該房屋之設備、設施的損壞，由甲方負責修繕。
With regard to the damages of the said Premises, fixtures and fittings which are not resulted from the improper use or negligence by Party B, Party A has the responsibility to repair or pay the cost of the repair.
3． 甲方在乙方入住前給乙方確認在 ________年___月 ___ 日入住時該房屋的所有設施、設備、電器、器具、水、電、煤氣等處於安全、良好的狀態。
Party A represents to Party B that on ______, ______ the Premises will be in good and safe condition and that all fixtures, services, and appliances will be in good working order and that the Premises will be ready for occupation by Party B.

六． 乙方責任 F. OBLIGATIONS OF PARTY B

1． 乙方不得擅自將承租的房屋和屋內設施轉租給他人使用。
Not allowed to sub-let the said Premises and facilities in the Premises to a third Party.
2． 乙方不得利用租賃的房屋和屋內設施從事有損公共利益和非法活動。
Not allowed to take part in any illegal activities or activities against the public interest in the said Premises or with the facilities in the Premises.
3． 乙方未經甲方同意不得做有損承租房屋建築結構的分隔、改裝。
Not allowed to make any alteration or addition to the structure of the said Premises.
4． 乙方對承租房屋及設施、設備有保管和愛護的責任；始終保持該房屋和屋內設施處於良好、安全的狀態；租賃期滿，乙方應將承租房屋和屋內設施恢復至承租開始之日狀態。因乙方使用不當或人為造成的事故、損失和損害，由乙方負責賠償或修復。
To maintain the interior of the Premises including the said fixtures and fittings at all times ring the tenancy term; Always keep the Premises and facilities in the Premises in good and safe condition; Deliver up the Premises and facilities in the Premises to Party A at the end of the tenancy term in the same good and clean state as they were at the commencement of the tenancy term. To be responsible for covering the loss and damage caused by the negligence act or default by Party B.
5． 未經甲方同意乙方不得在承租房屋內喂養寵物。
Not without the prior consent of Party A to keep or suffer to be kept in the Premises any pet.
6． 於租賃期最後兩個月中，當甲方或甲方指定的中介代理給予乙方合理的通知之後，乙方應同意由甲方或甲方指定的中介代理陪同潛在的承租人參觀房屋和屋內設施。
Permit Party A or Party A』s agents ring the last two months of the tenancy term to visit the premises and facilities in the Premises with reasonable notice together with any prospective tenants.
7． 於租賃期中，當甲方或甲方指定的中介代理給予乙方合理的通知之後，乙方應同意由甲方或甲方指定的中介代理陪同潛在的購房人參觀房屋和屋內設施。

七． 違約責任 G. BREACH OF AGREEMENT
1． 雙方都應嚴格遵守合同內容。如有一方欲終止合同需至少提前 30 天以書面形式向對方提出磋商，徵得對方同意後才有效；如有一方違約，違約方賠償人民幣 7037元作為違約金。
Both Parties should strictly follow this agreement. If any Party wishes to terminate this agreement, it should notify the other Party in writing at least 30 days in advance. Only after the approval by the other Party, the said termination shall become effective. Otherwise RMB 7,037 should be paid to the other Party as the penalty for breach of the agreement.
2． 乙方應按期交付房租費和明確屬於乙方應交付的所有費用。如乙方逾期兩周未繳納應付款項，甲方有權終止本合同、禁止乙方進入承租的房屋並不退還保證金。
Party B should pay the said rental and all of the fees on the said date. If Party B delays the payment more than two weeks in arrears, Party A has the right to terminate the said agreement, forbid Party B to access the Premises and take possession of the said deposit.
3． 乙方如果因某種原因被迫提出終止合同，但乙方找到另一位合適的客戶在同樣的條件下續租原定租賃期，使得甲方沒有因換客戶蒙受經濟損失；經甲方認可新的客戶後應准予乙方終止合同並不作違約處理,不收取違約金。
Should Party B be forced to request a termination of this agreement for any reason, and should Party B or property Agent succeed in finding a suitable tenant to rent the Premises under the same terms and conditions contained herein such that Party A will not suffer any financial impact as a result of such termination and Party A agrees to accept the new tenant, Party A should approve such request for termination and waive any said penalty.

八． 其他 H. OTHERS
1． 因不可抗力之原因造成損失，雙方應本著互諒、互讓的原則協商解決。
In respect of loss caused by a force beyond human control, both Parties should hold the principle of mutual understanding and mutual concession to resolve it.
2． 未盡事宜，經雙方協商一致，可訂立補充條款。
Both Parties agree to develop supplementary clauses after negotiation for any matter not addressed in this agreement.
3． 本合同一式三份，甲、乙兩方簽字後立即生效，甲、乙雙方及代理公司各執一份。
This agreement is in three copies, respectively to Party A, Party B and Agent. All of them have the same effect upon signing.

甲、乙雙方就房屋租賃事宜，達成如下協議:

第七條：押金
1、為保證本租房合同的全面履行，在簽訂本租房合同時，乙方應支付給甲方個月租金的押金，押金不計利息，租房合同終止時，退還乙方。若乙方不履行租房合同，則押金不予返還；若甲方不履行租房合同，則應將押金全額返還並賠償乙方壹個月的租金費用作為因租房造成的損失。但因市容整頓和市政動遷而無法續租的房屋除外，甲方可不作任何損失賠償，此合同即可終止。
2、租借期內，無特殊情況，甲乙雙方不得私自隨意加減租金和更改終止合同租借期。
3、甲方有權向乙方查閱支付國際長途的費用，或乙方使用國際長途電話，可由甲方代買"國際長途電話使用卡"，費用由乙方支付（根據卡上密碼可在室內電話機上直撥）。甲方有權向乙方追索。第八條：禁止租賃權的轉讓及轉借
乙方不得發生下列行為：
1、 租賃權轉讓或用作擔保。
2、 將租賃場所的全部或一部分轉借給第三者或讓第三者使用。
3、 未經甲方同意，在租賃場所內與第三者共同使用。

第九條：維修保養
1、 租賃場所內屬於甲方所有的內裝修及各種設備需要維修保養時，乙方應及時通知甲方或物業公司，甲方並及時安排維修保養。重要設備需要進行大修理時，應通知甲方。
2、 上述維修保養費用由甲方承擔，但若由於乙方原因造成的修理，則費用由乙方承擔。
3、 屬乙方所有的內裝修及各種設備需要保養時，由乙方自行進行並承擔費用。

第十條：變更原狀
1、 乙方如對所租的房屋重新裝修或變動設備及結構時，須事先徵得甲方的書面同意，所有費用由乙方承擔。
2、 乙方在實施上述工程時，須與甲方及時聯系，工程完畢後應通知甲方檢查。
3、 乙方違反本合同上述規定的，甲方有權要求恢復原狀，賠償損失。

第十一條：損害賠償
由於乙方及其使用人或有關人員的故意或重大過失行為而對甲方、其他租戶或者第三者造成損害時，一切賠償均由乙方承擔。

第十二條：甲方免責：
1、 因地震、水災、或非甲方故意造成，或非甲方過失造成的火災、盜竊、各種設備故障而引起的損害，甲方概不負責，但甲方有過錯或重大過失的情況除外。
2、 乙方因被其他客戶牽連而蒙受損害時，甲方概不負責。

第十三條：乙方責任
1、 必須遵守本大樓的物業管理制度。
2、 必須妥善使用租賃場所及公用部分。
3、 不得在大樓內發生下列行為：
（1） 將超重、易燃、易爆、易腐蝕等危險物品帶入樓內或實施其他有害於大樓安全的行為；
（2） 給甲方或其他租戶（業主）帶來損害的行為，以及對整個建築物造成損害的一切行為；
（3） 違反社會治安、國家安全和違法行為。

第十四條：通知義務
1、 甲乙雙方所發生的通知均採用書面形式。
2、 任一方的姓名、商號、地址及總公司所在地、代表者若發生變更時，須及時以書面形式通知另一方。

第十五條：合同終止
因自然災害及其他不可抗力事件，使大樓的全部或一部分損壞、破損而導致乙方租賃場所不能使用時，本合同自然終止。

第十六條：合同解除
乙方如發生以下行為之一時，甲方可不通知乙方而解除本租房合同租房合同，如對甲方造成損失的，乙方還應承擔賠償經濟損失的責任。
1、 租金及其他債務超過半個月以上未付；
2、 租賃場所的使用違反本合同第一條規定的；
3、 違反本合同的有關規定的；
4、 違反本合同第八、第十四條規定的；
5、 給其他租戶（業主）生活造成嚴重妨礙，租戶（業主）反映強烈的；
6、 觸犯法律、法規、被拘留或成為刑事訴訟（公訴）被告的，以及本人死亡或被宣告失蹤等情況發生的；
7、 有明顯失信或欺詐行為的事實的；
8、 甲方出現前述第3、4或第7項行為的，乙方有權不通知甲方而解除租房合同，如對乙方造成損失的，甲方還應賠償乙方遭受的損失。

第十七條：特別說明
1、 除第十六條和第二十條所述原因外，租賃期內，乙方不得解除本租房合同。若遇特殊情況須解除時，須以書面形式提前一個月通知甲方，但不得收回押金。
2、 租房合同簽訂後，租賃期開始前，由於乙方原因須解除合同時，乙方須把已繳的押金作為違約金支付給甲方。

第十八條：租賃場所的歸還
合同終止時，乙方應將租賃場所內屬於乙方所有的一切物品，包括內裝修各類設備、材料全部撤除，使租賃場所恢復原狀，並經甲方檢查認可後由甲方收回，所需費用由乙方承擔。

第十九條：糾紛解決
對本合同的權力、義務發生爭議時，如調解不成，可向有關管轄的房屋所在地的中國法院提出訴訟。
