廣州動腦廣告有限公司接深圳騰訊公司委託後，於2000年二三月完成對OICQ企鵝圖形的設計並得到騰訊公司的認可。同年6月中旬，騰訊公司分別在《南方都市報》及《南方周末》上刊登其委託廣州動腦廣告有限公司製作的廣告及該圖形標志。
2000年8月15日，騰訊又與廣州動腦廣告有限公司簽訂《版權歸屬合同》，約定包括OICQ企鵝圖形在內的「騰訊QQ系列圖畫」作品的作者為廣州動腦廣告有限公司，而騰訊擁有這些作品的著作權。
2001年6月20日，騰訊將該「騰訊QQ系列圖畫」在廣東省版權局進行著作權登記並獲頒證。
