⑴ 北京发布新版租房合同示范文本：明确禁止违法群租

记者7月8日从北京市住建委获悉，为合理引导住房租赁行为，维护租赁当事人合法权益，减少交易纠纷，降低交易成本，北京市住建委会同北京市市场监管局制定并发布《北京市住房租赁合同》《北京市房屋出租经纪服务合同》《北京市房屋承租经纪服务合同》三个合同示范文本。示范文本自发布之日起正式推行使用。

记者了解到，不同于2008年版的房屋租赁合同示范文本只是根据租赁的不同成交方式进行区分，此次发布的三个合同示范文本是分别针对住房租赁和房屋租赁经纪服务制定的，合同使用区分更加明确。

无论是通过自行成交的，或是通过经纪机构居间成交、经纪机构代理成交的，住房租赁合同均可统一使用《北京市住房租赁合同》示范文本。《北京市房屋出租经纪服务合同》《北京市房屋承租经纪服务合同》示范文本则适用于北京市依法可以出租房屋的租赁经纪服务。
此外，新版住房租赁合同增加了禁止违法群租的相关要求。《北京市住房租赁合同》《北京市房屋出租经纪服务合同》示范文本均在说明中强调，不得改变房屋内部结构分割出租、出租房屋人均居住面积不得低于5平方米、每个房间居住的人数不得超过2人等有关禁止违法群租的文件规定内容。
同时，在合同中通过设立房屋整租、分租有关事项条款，明确禁止违法群租。在《北京市住房租赁合同》示范文本中，专设有“房屋租赁形式”相关条款，约定房屋具体居住人数及分间出租时的分租房间居住面积；在《北京市房屋出租经纪服务合同》示范文本“委托出租要求”中，也明确约定了最多居住人数。

一． 租赁标的 A. TENANCY LOCATION

二． 租赁期限 B. TENANCY TERM
租期为 13个 月。自 ____年 6 月 1 日起至 _____ 年 5 月 30 日止。租赁期满，甲方有权收回全部出租之房屋和屋内设施，乙方应如期交还。乙方如要求续租，则必须在租赁期满前的 一 个月向甲方提出书面意向。经甲方同意后，重新签署租赁合同。

三． 租金与押金 C. RENTAL CHARGE AND DEPOSIT
该房屋和屋内设施月租金为人民币 7037(柒仟零叁拾柒) 元整。在租赁期内全部租金分 13 次支付。签署本合同时乙方向甲方交付人民币 14307(壹万肆仟叁佰零柒)元当作保证金和 1个月的租金和一个月的物业管理费，先付后住。乙方在租赁期内，7月份开始，每月租金和物业管理费须提前3天， 每月的27日向甲方交付，先付后住。人民币 7037 元保证金作为设备、设施被破坏而发生的损失或违约责任的保证。该保证金在租约期满结清各种费用后应予以退还（不计利息）。届时如乙方尚有本合同第四条中所述费用的未结清部分，甲方可以从该保证金中扣除相应数额；如结清有余，此部分余款应归还乙方。
The monthly rental charge of the Premises and facilities in the Premises is RMB 7037 . The rental should be paid by 13 installments within the tenancy period. Party B should pay Party A RMB 14,307 immediately after signing this agreement as the deposit and for 1 month’s rental charge and the management fee, and Party B can only access the Premises after the payments are fully made. From the second tenancy month, Party B should pay the monthly rental charge and management fee RMB7270 on the date of 27th of last tenancy month, and Party B can only access the Premises after the payment is fully made. The said deposit RMB 7037 is held against the damages of fixtures and fittings or breach of the agreement and shall be refunded (non-interest bearing) to Party B at the termination of this agreement subject to an appropriate dection in respect of the damage of fixtures and fittings or breach of the agreement. Party A has the right to dect an appropriate sum of the deposit if some payment, for other charges as described in the Article D of this agreement, are unpaid by Party B at the end of the tenancy term, then the remainders shall be refunded to Part B.

四． 费用 D. OTHER CHARGES
在租赁期内，由乙方使用的水、电、煤、有线电视、电话、(宽带网)，物业管理费由乙方支付（也可由甲方代乙方支付，之后根据付款凭据向乙方索取）。
During the tenancy term, Party B will pay its utilities of water, electricity, gas, telephone (ADSL), premises management fee, TV fee and other expenditures (It is available that Party A pays such charges on behalf of Party B, then Party B refunds Party A for such charges upon presentation of such receipts).

五． 甲方责任 E. OBLIGATIONS OF PARTY A
1． 甲方按约定在第一次收款后应在约定日期交给乙方使用。如延误交房日期,甲方须对乙方做出合理的补偿。
Party A promises to Party B to render the Premises on the said date after receiving the said first payment. Otherwise Party A should offer reasonable compensation to Party B if Party A fails to render as promised.
2． 非乙方人为因素造成的对该房屋之设备、设施的损坏，由甲方负责修缮。
With regard to the damages of the said Premises, fixtures and fittings which are not resulted from the improper use or negligence by Party B, Party A has the responsibility to repair or pay the cost of the repair.
3． 甲方在乙方入住前给乙方确认在 ________年___月 ___ 日入住时该房屋的所有设施、设备、电器、器具、水、电、煤气等处于安全、良好的状态。
Party A represents to Party B that on ______, ______ the Premises will be in good and safe condition and that all fixtures, services, and appliances will be in good working order and that the Premises will be ready for occupation by Party B.

六． 乙方责任 F. OBLIGATIONS OF PARTY B

1． 乙方不得擅自将承租的房屋和屋内设施转租给他人使用。
Not allowed to sub-let the said Premises and facilities in the Premises to a third Party.
2． 乙方不得利用租赁的房屋和屋内设施从事有损公共利益和非法活动。
Not allowed to take part in any illegal activities or activities against the public interest in the said Premises or with the facilities in the Premises.
3． 乙方未经甲方同意不得做有损承租房屋建筑结构的分隔、改装。
Not allowed to make any alteration or addition to the structure of the said Premises.
4． 乙方对承租房屋及设施、设备有保管和爱护的责任；始终保持该房屋和屋内设施处于良好、安全的状态；租赁期满，乙方应将承租房屋和屋内设施恢复至承租开始之日状态。因乙方使用不当或人为造成的事故、损失和损害，由乙方负责赔偿或修复。
To maintain the interior of the Premises including the said fixtures and fittings at all times ring the tenancy term; Always keep the Premises and facilities in the Premises in good and safe condition; Deliver up the Premises and facilities in the Premises to Party A at the end of the tenancy term in the same good and clean state as they were at the commencement of the tenancy term. To be responsible for covering the loss and damage caused by the negligence act or default by Party B.
5． 未经甲方同意乙方不得在承租房屋内喂养宠物。
Not without the prior consent of Party A to keep or suffer to be kept in the Premises any pet.
6． 于租赁期最后两个月中，当甲方或甲方指定的中介代理给予乙方合理的通知之后，乙方应同意由甲方或甲方指定的中介代理陪同潜在的承租人参观房屋和屋内设施。
Permit Party A or Party A’s agents ring the last two months of the tenancy term to visit the premises and facilities in the Premises with reasonable notice together with any prospective tenants.
7． 于租赁期中，当甲方或甲方指定的中介代理给予乙方合理的通知之后，乙方应同意由甲方或甲方指定的中介代理陪同潜在的购房人参观房屋和屋内设施。

七． 违约责任 G. BREACH OF AGREEMENT
1． 双方都应严格遵守合同内容。如有一方欲终止合同需至少提前 30 天以书面形式向对方提出磋商，征得对方同意后才有效；如有一方违约，违约方赔偿人民币 7037元作为违约金。
Both Parties should strictly follow this agreement. If any Party wishes to terminate this agreement, it should notify the other Party in writing at least 30 days in advance. Only after the approval by the other Party, the said termination shall become effective. Otherwise RMB 7,037 should be paid to the other Party as the penalty for breach of the agreement.
2． 乙方应按期交付房租费和明确属于乙方应交付的所有费用。如乙方逾期两周未缴纳应付款项，甲方有权终止本合同、禁止乙方进入承租的房屋并不退还保证金。
Party B should pay the said rental and all of the fees on the said date. If Party B delays the payment more than two weeks in arrears, Party A has the right to terminate the said agreement, forbid Party B to access the Premises and take possession of the said deposit.
3． 乙方如果因某种原因被迫提出终止合同，但乙方找到另一位合适的客户在同样的条件下续租原定租赁期，使得甲方没有因换客户蒙受经济损失；经甲方认可新的客户后应准予乙方终止合同并不作违约处理,不收取违约金。
Should Party B be forced to request a termination of this agreement for any reason, and should Party B or property Agent succeed in finding a suitable tenant to rent the Premises under the same terms and conditions contained herein such that Party A will not suffer any financial impact as a result of such termination and Party A agrees to accept the new tenant, Party A should approve such request for termination and waive any said penalty.

八． 其他 H. OTHERS
1． 因不可抗力之原因造成损失，双方应本着互谅、互让的原则协商解决。
In respect of loss caused by a force beyond human control, both Parties should hold the principle of mutual understanding and mutual concession to resolve it.
2． 未尽事宜，经双方协商一致，可订立补充条款。
Both Parties agree to develop supplementary clauses after negotiation for any matter not addressed in this agreement.
3． 本合同一式三份，甲、乙两方签字后立即生效，甲、乙双方及代理公司各执一份。
This agreement is in three copies, respectively to Party A, Party B and Agent. All of them have the same effect upon signing.

甲、乙双方就房屋租赁事宜，达成如下协议:

第七条：押金
1、为保证本租房合同的全面履行，在签订本租房合同时，乙方应支付给甲方个月租金的押金，押金不计利息，租房合同终止时，退还乙方。若乙方不履行租房合同，则押金不予返还；若甲方不履行租房合同，则应将押金全额返还并赔偿乙方壹个月的租金费用作为因租房造成的损失。但因市容整顿和市政动迁而无法续租的房屋除外，甲方可不作任何损失赔偿，此合同即可终止。
2、租借期内，无特殊情况，甲乙双方不得私自随意加减租金和更改终止合同租借期。
3、甲方有权向乙方查阅支付国际长途的费用，或乙方使用国际长途电话，可由甲方代买"国际长途电话使用卡"，费用由乙方支付（根据卡上密码可在室内电话机上直拨）。甲方有权向乙方追索。第八条：禁止租赁权的转让及转借
乙方不得发生下列行为：
1、 租赁权转让或用作担保。
2、 将租赁场所的全部或一部分转借给第三者或让第三者使用。
3、 未经甲方同意，在租赁场所内与第三者共同使用。

第九条：维修保养
1、 租赁场所内属于甲方所有的内装修及各种设备需要维修保养时，乙方应及时通知甲方或物业公司，甲方并及时安排维修保养。重要设备需要进行大修理时，应通知甲方。
2、 上述维修保养费用由甲方承担，但若由于乙方原因造成的修理，则费用由乙方承担。
3、 属乙方所有的内装修及各种设备需要保养时，由乙方自行进行并承担费用。

第十条：变更原状
1、 乙方如对所租的房屋重新装修或变动设备及结构时，须事先征得甲方的书面同意，所有费用由乙方承担。
2、 乙方在实施上述工程时，须与甲方及时联系，工程完毕后应通知甲方检查。
3、 乙方违反本合同上述规定的，甲方有权要求恢复原状，赔偿损失。

第十一条：损害赔偿
由于乙方及其使用人或有关人员的故意或重大过失行为而对甲方、其他租户或者第三者造成损害时，一切赔偿均由乙方承担。

第十二条：甲方免责：
1、 因地震、水灾、或非甲方故意造成，或非甲方过失造成的火灾、盗窃、各种设备故障而引起的损害，甲方概不负责，但甲方有过错或重大过失的情况除外。
2、 乙方因被其他客户牵连而蒙受损害时，甲方概不负责。

第十三条：乙方责任
1、 必须遵守本大楼的物业管理制度。
2、 必须妥善使用租赁场所及公用部分。
3、 不得在大楼内发生下列行为：
（1） 将超重、易燃、易爆、易腐蚀等危险物品带入楼内或实施其他有害于大楼安全的行为；
（2） 给甲方或其他租户（业主）带来损害的行为，以及对整个建筑物造成损害的一切行为；
（3） 违反社会治安、国家安全和违法行为。

第十四条：通知义务
1、 甲乙双方所发生的通知均采用书面形式。
2、 任一方的姓名、商号、地址及总公司所在地、代表者若发生变更时，须及时以书面形式通知另一方。

第十五条：合同终止
因自然灾害及其他不可抗力事件，使大楼的全部或一部分损坏、破损而导致乙方租赁场所不能使用时，本合同自然终止。

第十六条：合同解除
乙方如发生以下行为之一时，甲方可不通知乙方而解除本租房合同租房合同，如对甲方造成损失的，乙方还应承担赔偿经济损失的责任。
1、 租金及其他债务超过半个月以上未付；
2、 租赁场所的使用违反本合同第一条规定的；
3、 违反本合同的有关规定的；
4、 违反本合同第八、第十四条规定的；
5、 给其他租户（业主）生活造成严重妨碍，租户（业主）反映强烈的；
6、 触犯法律、法规、被拘留或成为刑事诉讼（公诉）被告的，以及本人死亡或被宣告失踪等情况发生的；
7、 有明显失信或欺诈行为的事实的；
8、 甲方出现前述第3、4或第7项行为的，乙方有权不通知甲方而解除租房合同，如对乙方造成损失的，甲方还应赔偿乙方遭受的损失。

第十七条：特别说明
1、 除第十六条和第二十条所述原因外，租赁期内，乙方不得解除本租房合同。若遇特殊情况须解除时，须以书面形式提前一个月通知甲方，但不得收回押金。
2、 租房合同签订后，租赁期开始前，由于乙方原因须解除合同时，乙方须把已缴的押金作为违约金支付给甲方。

第十八条：租赁场所的归还
合同终止时，乙方应将租赁场所内属于乙方所有的一切物品，包括内装修各类设备、材料全部撤除，使租赁场所恢复原状，并经甲方检查认可后由甲方收回，所需费用由乙方承担。

第十九条：纠纷解决
对本合同的权力、义务发生争议时，如调解不成，可向有关管辖的房屋所在地的中国法院提出诉讼。
